Hi, I’m Stuart Talley with Kershaw, Cook & Talley, P.C. . Bill Kershaw and I are the partners responsible for providing a status update on the Stryker Rejuvenate and Stryker ABG II litigation case. We are providing information to clients, and individuals, dealing with Broadspire as a result of their recalled hip. We have submitted claims to Broadspire for reimbursement for various out of pocket expenses on our client’s behalf.

Through this process, we learned what Broadspire will or will not cover. Broadspire insurance will cover any out of pocket expenses you incurred. For instance, if you have a co pay, Broadspire will cover that cost. Many people ask, “How does this work?” You would submit your claim just like you would any other health related expense. Broadspire will also pay anything the insurance will not cover. You need to collect all hip related medical bills you receive. For our clients, we submit the bills to Broadspire who subsequently issues a check to our clients reimbursing them for that amount.

Unfortunately, we know some insurance companies who will not cover any medical expenses as a result of a recalled hip. We have clients with $50,000 worth of medical bills put into collections. In this case, Broadspire will cover these costs. We recommend you move quickly in order to avoid hurting your credit rating as a result of these medical bills. Broadspire also covers physical therapy expenses that may not be covered by your insurance. Many times insurance companies cover physical therapy for approximately one month after surgery and nothing more. Broadspire will cover the expenses from physical therapy if your doctor recommends more sessions after what is permitted by the insurance company. In addition, Broadspire covers fees associated with home health care. Broadspire possibly covers lost earnings; they reimburse you for out of pocket lost earnings, provided there is proper documentation. In some cases, we received reimbursement for Cobra for our clients after they lost their insurance.
